Its a sad week. :( First the whole sad saga over Super Junior. Lets start with the whole story.
It started with Hankyung, the PRC of Super Junior.
Hankyung, Super Junior's only Chinese member in the 13 member group, has filed a lawsuit against the effects of his exclusive contract with the defendant SM Entertainment because of their unfair activity scheduling which has caused him gastritis and kidney illness.
Through Hankyung's legal representative, the lawsuit to terminate his exclusive contract was filed on the 21st with the Seoul District Court.
According to the litigation, Hankyung has not even been given a single rest day per week after debut. It has been said, "Because of the recent continuous overseas activities etc, it has almost been 2 years since he last rested, he has been rushing schedules (all this while)." "Due to contract obligations and heavy penalties, even during bad health, he was not to skip any scheduled activities."
Hankyung's side emphasized, "Because of these kind of health problems, (he) has continuously put forward requests to rest, but has always been rejected." They added, "Except for when they started their perfomances in 2006, at other times, he had to stay in Korea." "Through their manager, Hankyung requested from SM for leave to return to China to rest but he was rejected every single time."
Hankyung's side added, Hankyung's exclusive contract terms ▶SM was definitely in a more superior position signing on unfair terms in the contract ▶The contract would span 13 years (starting from the release of their first album) ▶Incorporated excessive damages and in terms of the contract, if he voided it, he would be blocked (from other activities) ▶Allocation of rights and obligations in the contract were significantly off-balanced ▶SM had the right to request Hankyung to be in any activity ▶Profit-splitting rights and provisions were also off-balance, hence the intiation of the lawsuit against SM to terminate his exclusive contract.
On the other hand, after Hankyung intiated litigation, SM stated their stand that "for the sake of Super Junior and Hankyung, they are in talks to resolve the problem".
And then, some others decide to join him
[Sina Entertainment News] The day before, Hangeng, the only Chinese member of Asia's super popular group, Super Junior, filed for a termination of his "exclusive contract" with SM Entertainment. According to the latest news from Korea, Hangeng is not the only one who filed the lawsuit. Other Super Junior members have also filed a similar lawsuit, and they include: Lee Teuk, Yesung, Kangin, Eun Hyuk and Donghae. The only reason why news about Hangeng was exposed first, is because of his nationality.
According to the lawsuit, Hangeng has not had any rest in 2 years, causing him to suffer from fatigue, which also resulted in chronic gastritis, illnesses related to his kidney, lumbar disc herniation, as well as a visible decrease in body strength. However, SM Entertainment rejected Hangeng's requests for rest, and continued to schedule activities for him, which caused Hangeng to suffer a lot of pain.
According to the contents of the lawsuit, since the time of his debut, Hangeng didn't even have one day of rest per week. For 2 years, Hangeng has continuously done his overseas schedules as well, and had no choice but to continue with his schedules without any rest. In his contract with SM, there are clauses stating that he has to pay the company monetary damages should he be unable to fulfill the schedules arranged for him. Thus, even when he was in poor health, he had no choice but to follow through with his schedules.
Once the news broke out, many fans have expressed the wish for SM and the members to be able to make peace, and make changes to their contracts, as well as expressed hope that Super Junior will not face the threat of disbanding.

Though all of the members are at the backstage, a screen was used to separate them. To forbid interactions, staffs would be them to monitor each of the members. It was said that they were even unable to communicate with each other. At both of the Best Hit and FNS Music Festival held on November 26 and December 20 respectively, we were able to saw all of the members performing live on stage. However, they (TVXQ) were later said to be giving each other cold shoulders. However if the above stated was true (that they were having bad relationship), they wouldn't be talking with each other even if a screen wasn't there! It however shows that the strong bond between members still exists and thus, barriers were needed so to prevent communication.
Despite the on-going lawsuit, the members arrived in Japan on Mid - December for the PV's filming of their upcoming single - Break Out - said to be released on 2010. Similar to previous situation, a 3 - 2 formation was formed. 3 members stayed in hotel and flights scheduled that were different from the other 2 members. The atmosphere while filming the PV on December 15 and 16 was thus oddly tense.
Why? Apart from TVXQ's managers, there were also staffs from Koreans who arrived specifically to observe the members while filming. Not only did this occur when filming, they were also watched while taking break. This is a harsh and major blow for members whom once mentioned that they hope to perform as a group.
Max Chang Min seems to be having a silent protest as he rarely spoke. Sam-san who direct for this PV, is the dance instructor and big brother for TVXQ too. While not working, SAM - san and the members would go for a drink and too and hopefully, they (TVXQ) are able to pour their sorrows and feelings to him. It must be difficult for them all to be working in a tense atmosphere.
It is a difficult period for members and their fans now. The lawyer of the 3 members also expressed that the 3 members were extremely apologetic that they had made their fans upset.
It wasn't an easy decision for members to postpone the BIGEAST MEETING - one that they had been waiting eagerly - Xiah Jun Su also delayed the musical that he would be starring in so as to attend the meeting.
Fans hope that though they might not be in the current management company in the future, they (TVXQ) would be able to sing and perform on stage - as one.
As the New Year approaching, we hope that they will be able to BREAK OUT and pull through this crisis!
TVXQ has been monitored in private", Japanese media.
Japanese media revealed that while filming the latest PV in December, members of TVXQ were being forced not to communicate with each other.
SM Entertainment however responded that this is no evidence that they (SME) are monitoring the members in private.
On December 22, 2009, a Japanese weekly women magazine (Women's Self) stated that during the activities in Japan, the communication between TVXQ's has been forbidden and monitored since 3 of the members has filed a lawsuit against SME.
The magazine also wrote that during the activities in Japan, the members were unable to perform well as one. Though all of the members stayed in one room, there was a screen separating them into 3 - 2. Thus, this act seems to forbid interaction between members and to observe their actions. The same situation occurred while they were filming for the PV of their upcoming Japanese single, Break Out. Though the MV was filmed in Japan, there were staffs following them to disallow communication between members.
With regards to this, SME's representative replied via phone, "The article by Women's Self is purely rumour. It is creepy to have this thought that the members are being watched closely. Furthermore, we are in the generation where communication devices are everywhere. This could happen in the 1990s but in today's situation; monitoring them (TVXQ) is implausible and impossible. "
FUCK. A partition to separate them???!?! and Netizens have noticed that Changmin is in silent protest refusing even to open his mouth to "we are tohoshinki". :(
I can't take the shock! If Super Junior were to end up in this sorry sorry state, sigh, life would really suck. Best situation, all 13 remain united and sue SM together. (Ideal situation) However, seeing as Kibum is going to star in some movie or what he would mostly probably stay with SM.
